AGREEMENT TO RENT

OxiMedical agrees to rent to Client (“Client” is defined as both the payer and the user of the equipment if not the same), and Client agrees to rent from OxiMedical the portable concentrator package, hereafter designated Equipment, as detailed on Rental Invoice, and except as otherwise provided herein, will continue until the end of the Effective Dates of the Rental. The Client agrees to use the Equipment as directed by OxiMedical. 

TERMS OF OXIMEDICAL LONG TERM RENTAL PROGRAM

• Long term rentals will be a minimum of 8 months long
• $200 refundable deposit will be required at the time of rental set up prior to shipment
• $295 1st month rental fee will be required at the time of rental set up prior to shipment
• $99 will be collected for a minimum of 7 months thereafter
• Client must have a Credit Card on file with OXIMEDICAL
• Client must have a Checking Account on file with OXIMEDICAL
• Client must have a Emergency Contact on file with OXIMEDICAL
• Client must have a current oxygen prescription on file with OXIMEDICAL
• Client must agree to the the Terms and Client Responsibilities of this Rental Agreement
• Client has the option to purchase the rental equipment at any time during the rental period.
• Client may use 1st month rental fee plus deposit towards the purchase of the equipment. 
• Portable Oxygen Concentrator Long Term Rental brand will be at the discretion of OXIMEDICAL

CLIENT RESPONSIBILITIES

1. Client agrees that rental equipment will be used with reasonable care, not altered or modified, and returned in good condition (normal wear and tear expected). 
2. Client agrees to promptly report to OXIMEDICAL any malfunctions or defects in the rental equipment so that repair / replacement can be arranged. 
3. Client agrees to use the equipment for the purposes so indicated and in compliance with the physician’s prescription. 
4. Client agrees to keep the equipment in their possession.
5. Client agrees to retrain the equipment in the 50 United States of America. 
6. Client agrees to pay for the replacement cost of equipment damaged, destroyed, or lost due to misuse, abuse, neglect or theft. 
7. Client agrees to keep the equipment in a smoke-free environment at all times and agrees to pay for any nicotine / smoke odor damage. 
8. Client agrees not to modify the rental equipment without the prior written consent of OXIMEDICAL.
9. Client agrees that any authorized modification shall belong to OXIMEDICAL unless the equipment is purchased and paid for in full. 
10. Client agrees to contact OXIMEDICAL to extend the rental period prior to the end of the current rental period agreement.
11. Client agrees to contact OXIMEDICAL to return rental equipment prior to the end of the current rental period agreement to arrange return service. 
12. Client agrees that titles to the rental equipment and all parts shall remain with OXIMEDICAL at all times unless equipment is purchased and paid for in full. 
13. Client agrees that OXIMEDICAL shall nor insure or be responsible to the client for any personal injury or property damage related to any equipment; including that caused by use or improper functioning of equipment; the act or omission of any other third party, or by any criminal act or activity, war, riot, insurrection, fire, or act of God. 
14. Client agrees that any legal fees resulting from a disagreement between the parties shall be borne by the unsuccessful party in any legal action taken.
